NOTICE TO JUDGMENT DEBTOR

Sale or mortgage of the land

You are entitled to sell or mortgage the land, but only in accordance with section 113 of the Civil Procedure Act 2005. Under this section the judgment creditor must consent in writing to the sale or mortgage of the land. The judgment creditor must also stipulate in the notice of consent the minimum amount to be paid to the Sheriff from the proceeds of the sale of the land or from the money advanced under the mortgage of the land. You must then lodge the judgment creditor's notice of consent with the Sheriff.

Payment of the debt by instalments

You are entitled to apply for an instalment order under section 107 of the Civil Procedure Act 2005. If the court makes an instalment order the sale of the land will not proceed while the order is in force.
